These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Enally.in ("Enally", "we", "us", or "our"), operated by Prashant Kumar (Sole Proprietor), Office: NX-ONE, Gaur City, Greater Noida West, UP - 201306. Registered: C/O 99 APO, 9 Assam Rifles, Kohima Sadar 270, Kohima, Nagaland - 797004 (MSME: UDYAM-PB-11-0041847), concerning your access to and use of enally.in as well as any other media form, media channel, or application related, linked, or otherwise connected thereto (collectively, the "Site").
IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY. We reserve the right to make changes or modifications to these Terms at any time. It is your responsibility to periodically review these Terms. You will be deemed to have accepted the changes by your continued use of the Site after the date such revised Terms are posted. The Site is intended for users who are at least 13 years of age.

Prohibited activities
You may not: systematically retrieve data to create compilations without written permission; trick, defraud, or mislead us or other users; circumvent security-related features; disparage or harm us or the Site; use information to harass or harm another person; make improper use of support services; use the Site to advertise or sell goods without authorization; engage in unauthorized framing or linking; upload viruses or malware; engage in data mining or scraping; impersonate another user; or attempt to bypass access restrictions.
User submissions
Content you submit through forms remains your property. By submitting, you grant Enally a non-exclusive, royalty-free license to use this information to respond to you and fulfill your request. We will not publish your private submissions publicly without explicit consent.
Account responsibility
Where accounts are required, you are responsible for maintaining the confidentiality of your password and all activities under your account. We reserve the right to remove, reclaim, or change a username if we determine it to be inappropriate, obscene, or objectionable.
Services and payments
4. Services, Payments & Third-Party Links.
Service engagements
All paid services (development, consulting, design, AI solutions) are governed by separate service proposals or agreements. These Terms supplement those specific agreements. Service descriptions on the Site are for general information only and do not constitute binding offers.
Payment processing
All payments are processed securely through PayU. Enally does not store credit card numbers or sensitive payment credentials. By making a purchase, you agree to PayU terms. Payment schedules and milestones are defined in individual service agreements.
Third-party links
The Site contains links to third-party websites including Archilo, Humble, Faaho, and external services. We have no control over their content, privacy practices, or availability. Linking does not imply endorsement. You access third-party sites at your own risk and subject to their own terms.
Service availability
We aim to maintain website availability but provide no guarantee of uninterrupted, secure, or error-free operation. We may perform maintenance, updates, or modifications without prior notice. Content, products, pricing, and opportunities may change.
Liability and law
5. Limitation of Liability, Governing Law & Disputes.

TO THE FULLEST EXTENT PERMITTED BY LAW, ENALLY SHALL NOT BE LIABLE FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, ARISING FROM YOUR USE OF THE SITE OR SERVICES. Our total liability shall not exceed the amount paid by you in the preceding 12 months for the specific service giving rise to the claim.
Indemnification
You agree to defend, indemnify, and hold harmless Enally, its owner, affiliates, and service providers from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from your violation of these Terms, your use of the Site, or your violation of any third-party rights.
Governing law
These Terms shall be governed by and construed in accordance with the laws of India. Any legal action shall be brought exclusively in the courts located in Gautam Buddh Nagar (Greater Noida), Uttar Pradesh, India.
Dispute resolution
We encourage amicable resolution through written communication to admin@enally.in. If not resolved within 30 days, either party may pursue legal remedies. For service disputes, both parties agree to attempt mediation before litigation.
Severability and termination
If any provision is found invalid or unenforceable, the remaining provisions continue in full force. We may terminate or suspend access immediately without prior notice for conduct that violates these Terms. Upon termination, your right to use the Site ceases immediately.
Entire agreement
These Terms, together with the Privacy Policy, Refund Policy, and any service-specific agreements, constitute the entire agreement between you and Enally regarding the Site and supersede all prior agreements and understandings.
